Terms of Use

These terms are the deal between you and Loamkeep. Using the app or the website means you accept them.
1. Accepting these terms
By using the Loamkeep website or app, you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use Loamkeep.
These terms are a contract between you and the sole independent developer who operates Loamkeep ("Loamkeep", "we", "us"), reachable at support@loamkeep.com. They are not a contract with Apple or Google.
2. What Loamkeep is
Loamkeep helps you use social media on purpose. You choose which apps to gate, and you earn minutes to open them by walking, working out, or meditating. Apple Health measures your activity on your device.
Loamkeep is a wellbeing and productivity tool. It is not a medical device, a health service, or a substitute for professional advice.
3. Who can use it
You must be at least 16 years old to use Loamkeep. By using it, you confirm you meet this requirement.
4. Your account
You are responsible for keeping your account secure and for activity that happens under it. Tell us at support@loamkeep.com if you think your account has been compromised.
Health disclaimer
Loamkeep encourages physical activity. Exercise carries risk. Talk to a doctor before starting any new exercise routine, especially if you have a health condition, are pregnant, or have any doubt about your fitness to exercise. You take part in any activity at your own risk. Loamkeep is not responsible for injury or health outcomes, and nothing in the app is medical advice.
5. App blocking is best-effort
Loamkeep uses Apple's Screen Time features to gate the apps you choose. These features have limits set by the operating system. We cannot guarantee that gating is complete, uninterrupted, or impossible to bypass. Loamkeep is a tool to support your intentions, not a lock we promise cannot be broken.
6. Acceptable use
Do not misuse Loamkeep. In particular, do not:
- Break the law or infringe anyone's rights while using it.
- Try to reverse engineer, disrupt, or gain unauthorised access to the service.
- Use it in a way that harms Loamkeep or other users.
7. Paid features and referral codes
Some features may require payment. Access granted through a referral or promo code lasts for the period stated when the code is redeemed, and may be time-limited or permanent. We may change, add, or remove paid features, and we will give reasonable notice of material changes. Purchases made through the App Store are also subject to Apple's terms and refund rules.
If a feature is sold as an auto-renewing subscription, it renews until you cancel. You can cancel at any time in your App Store subscription settings, and cancellation takes effect at the end of the current billing period. Refunds for App Store purchases are handled by Apple under Apple's refund policy.
8. Our content and rights
Loamkeep, including its name, design, and software, belongs to us and is protected by law. We grant you a personal, non-transferable, revocable licence to use the app for its intended purpose. You keep ownership of your own data.
9. Third-party services
Loamkeep relies on services such as Apple Health, the App Store, and Sign in with Apple or Google. Your use of those is subject to their own terms, and we are not responsible for them.
Our website and app may also link to third-party sites and content. We do not control them and are not responsible for what you find there.
10. Apple App Store terms
If you downloaded Loamkeep from Apple's App Store, the following also applies:
- These terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the app.
- Your licence to use the app is limited to Apple-branded devices you own or control, as permitted by the App Store's usage rules.
- If the app fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
- Apple is not responsible for handling any claims relating to the app, including product liability, regulatory compliance, or intellectual property claims.
- You confirm that you are not located in a country subject to a US government embargo and are not on any US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
11. Disclaimers
Loamkeep is provided "as is" and "as available". To the fullest extent allowed by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and that the service will be uninterrupted or error-free.
12. Limitation of liability
To the fullest extent allowed by law, Loamkeep is not liable for indirect, incidental, or consequential damages, or for loss of data or profits, arising from your use of the service. Nothing in these terms limits liability that cannot be limited by law, such as for death or personal injury caused by our negligence. Your statutory consumer rights are not affected.
If your breach of these terms or your misuse of the service causes a third party to bring a claim against us, you agree to compensate us for the reasonable losses that result, to the extent permitted by the law of your country of residence.
13. Ending your use
You can stop using Loamkeep and delete your account at any time. We may suspend or end your access if you break these terms or misuse the service.
14. Changes to these terms
We may update these terms. If a change is material, we will update the date above and, where appropriate, notify you. Continuing to use Loamkeep after a change means you accept the updated terms.
15. Governing law
These terms are governed by the laws of Romania, and any dispute will be handled by the courts there, without affecting any mandatory consumer protections in your own country of residence.
16. General
These terms and the Privacy Policy are the entire agreement between you and us about Loamkeep. If any part of these terms is found unenforceable, the rest stays in effect. If we do not enforce a provision, that is not a waiver of it. You may not transfer your rights under these terms to anyone else; we may transfer ours as part of a sale or reorganisation of Loamkeep, and we will notify you if that happens.
